AGI Calculator Beta Terms of Use
Ontario Renters Coalition
Version 1.2 | Revised October 11, 2026
Effective when published with the calculator
These terms apply to the Ontario Renters Coalition (ORC) AGI Calculator and its accompanying original instructions. By selecting the agreement checkbox and using the calculator, you agree to the version of these terms displayed at that time. If you do not agree, do not use the calculator.
1 Beta status and legal framework
The calculator is a beta tool. ORC is testing it with tenant-association networks to assess accuracy, identify errors and improve usability. Testing is ongoing. A result remains an estimate, even when it matches another calculation.
The calculator is based on ORC’s interpretation and implementation of Ontario’s residential-tenancy laws and applicable guidance. Applicable law and legal decisions prevail over any calculator output or explanation.
The calculator’s accuracy has not been confirmed by the Landlord and Tenant Board (LTB). The calculator has not been approved, certified or endorsed by the LTB or the Government of Ontario. References and links to their materials do not imply endorsement.
2 Purpose and scope
The calculator supports education, tenant organising and analysis of capital-expense above-guideline increase (AGI) claims. It estimates one percentage for the building group entered. It does not assess the legal eligibility of expenses or automatically determine the correct allocation of costs among units or building groups.
The current beta excludes individual tenant adjustments, municipal-tax claims and security-service operating costs. A first-year estimate is not a complete later-year recovery schedule or rent-decrease calculation. Cases involving different affected groups or special statutory rules may require separate analysis.
3 No substitute for case-specific advice
The calculator and instructions provide general information, not legal or financial advice. Using them does not create a lawyer-client, representative or other professional advisory relationship with ORC.
Do not rely on an output alone to decide what rent to pay, whether to accept a settlement or what to file with the LTB. An estimate does not determine the amount legally payable, establish that a cost must be removed or recommend a settlement. Check the source records and seek qualified advice where needed. Actual notices, applicable law and LTB orders govern your rights and obligations. The tool does not file documents, represent you or extend any deadline.
4 Your inputs and records
You are responsible for checking the figures and assumptions you enter, including the affected monthly rent roll, applicable mortgage rate and date, rent increase guideline, capital AGI requested on the N1 notice, project costs, deductions, useful lives and allocation to affected units. Costs and rents must relate to the same building group. Labels such as “eligible cost” and “eligible capital costs” do not confirm legal eligibility.
Before relying on an estimate, independently check both the inputs and the result against the supporting records and applicable calculation requirements. Confirm the assumptions and investigate discrepancies; correct inputs alone do not guarantee a correct result. Keep copies of the source records, inputs, results, calculation date and available version identifier. Changes to inputs, software or legal interpretation may produce different results.
5 Permitted use and sharing
Subject to these terms, ORC grants you limited, non-exclusive permission to use the calculator for personal use, tenant education, organising, advocacy and analysis of AGI claims. Advisers and representatives may use it to assist their clients. You may share your own inputs and outputs with tenants, association members, advisers or representatives and include them in case materials, subject to applicable evidence and procedural rules.
When sharing an output, identify it as an ORC beta calculator estimate and include the calculation date, relevant inputs or assumptions and any calculator version identifier displayed with the result. Do not describe it as an LTB-approved result or imply that ORC has reviewed your particular case. Share only information you are authorised to disclose.
You may download, print and share ORC’s user guide unchanged for non-commercial tenant education or organising, with attribution to ORC. You may also link to the calculator and guide. This permission does not permit repackaging the guide as your own work or selling it.
Do not bypass access controls, interfere with the service or use it unlawfully. Copying and redistribution of ORC materials are addressed in section 6.
6 Intellectual property and permitted copying
The calculator’s original software code, original interface design, branding and original instructional content are proprietary materials of Ontario Renters Coalition, subject to applicable law and any third-party rights or licences. ORC reserves all intellectual property rights it holds in those materials. Permission to use the calculator does not transfer ownership or grant permission to reproduce or operate its software elsewhere.
Except for sharing expressly permitted in section 5, a use permitted by law or an applicable third-party licence, you must obtain ORC’s written permission before reproducing, redistributing, selling or hosting its protected original software, interface design or a substantial part of its original instructional content.
ORC does not claim ownership of publicly available mathematical formulas or methods, legislation, legal rules or public facts. You may independently check, discuss and criticise the results and implement public calculation methods using your own independently developed code. This permission does not authorise copying ORC’s protected original expression. Nothing in these terms restricts uses permitted by applicable law or an applicable third-party licence.
You retain rights you hold in your inputs and case materials. If you voluntarily provide non-confidential suggestions about the tool, you give ORC a non-exclusive, royalty-free permission to use those suggestions to improve it. That permission does not authorise publication of confidential case records or personal information.
7 Privacy and beta feedback
Enter aggregate figures and non-identifying project descriptions. Do not enter tenant names, addresses, contact details, account numbers or other unnecessary personal information. The entered calculation figures are sent to ORC’s website server to produce the result. The calculator software does not save those entries in a calculator database. This does not mean that website operational or security logs, or emails sent to ORC, are never retained.
Feedback is voluntary. A feedback email is handled separately from the calculation and may be retained in ORC’s email system. Redact unnecessary personal information from any supporting records before sending them, ensure you are authorised to share them and agree an appropriate sharing method with ORC first. These terms do not give ORC permission to publish confidential case materials or personal information. Sending feedback does not create representation, guarantee a case review or promise a response before any deadline. Do not delay taking action while waiting for a reply.
The current calculator does not accept L5 or rent-roll document uploads. A future upload or AI-assisted feature will require separate disclosures about providers, processing and retention, and any required agreement before documents are submitted. Acceptance of these terms does not authorise that future processing.
8 Availability and accuracy
To the extent permitted by applicable law, the calculator and instructions are provided as is and as available, without express or implied warranties of accuracy, completeness, currency, uninterrupted operation or suitability for a particular case. Errors may arise from the software or its interpretation of calculation requirements even when your inputs are correct. ORC may correct errors, update the tool, restrict access or end the beta. Keep your own records and check whether a newer version changes an earlier result.
ORC’s testing and review do not guarantee an LTB outcome. Differences can arise from inputs, excluded matters, disputed eligibility, allocation, interpretation or the evidence accepted in a case.
9 Limits of liability and preserved rights
To the extent permitted by applicable law, ORC and its directors, officers, staff and volunteers acting on its behalf are not liable for direct, indirect or consequential losses, damages, costs or expenses arising from use of, inability to use or reliance on the calculator or accompanying instructions. This includes losses arising from calculation errors, omissions, inaccurate inputs or outputs, outdated information or decisions made using an estimate, whether a claim is based on contract, negligence or another legal basis. These exclusions do not apply to liability that cannot lawfully be excluded or limited, or to liability for fraud, wilful misconduct or gross negligence.
Nothing in these terms waives a tenant’s statutory rights, changes a landlord’s obligations, limits access to the LTB or courts, or removes any non-waivable rights or remedies under applicable law.
10 External resources
Links to government, legal-clinic and tenant-organisation resources are provided for convenience. Those providers are responsible for their own content and services, which may change and may have separate terms. A link does not mean the provider has tested or endorsed this calculator.
11 Access and future changes
Public beta access is free through December 31, 2026. ORC plans to introduce membership access after that period. Membership eligibility, fees and any paid features will be explained separately before they take effect. Accepting these terms or using the free beta does not enrol you in a paid membership or authorise a charge. Temporary access restrictions may apply during testing, maintenance or security checks.
Donations are voluntary and do not affect access to the free beta or its results. Card donations are handled by the payment provider linked on the page, under its applicable terms. Donating does not purchase membership or any additional calculator service.
ORC may revise these terms for future use and will display the revised version and its effective date. ORC will bring material changes to users’ attention before asking them to accept the revised terms. Changes do not retroactively authorise charges or expand permission to use previously submitted information.
12 Applicable law and contact
These terms are governed by the laws of Ontario and the applicable federal laws of Canada, subject to any mandatory protections that apply to you. They do not require private arbitration or waive access to lawful dispute-resolution processes.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Any mandatory protections that apply to you prevail over conflicting wording in these terms.
